<h2 id="what-expect">What Can I Expect From a Substance Abuse Helpline?</h2>
Addiction helplines can answer various questions you may have about substance abuse and the recovery process. When you call, a qualified substance abuse representative will answer the phone and assist you. You can tell the representative what substances you are currently struggling with. The helpline representative will talk to you about the different treatment plans that will work specifically for your addiction problem. They will also ask for your zip code so they can populate a list of current providers in your area. If you want to seek treatment in a different location, just let them know, and they will check for rehab centers in that area.

<h2 id="medicare">What is Medicare?</h2>
Medicare is a government-funded insurance program that helps provide healthcare to individuals over the age of 65. Medicare was signed into law in 1965 by President Lyndon B. Johnson.2 Today, Medicare helps provide healthcare to millions of eligible Americans every year. Medicare consists of three parts:3
<ul>
 	<li>Medicare Part A: Covers inpatient hospital care, skilled nursing facility care, hospice, and some home health care.</li>
 	<li>Medicare Part B: Covers doctor office visits and services, outpatient care, medical supplies, and preventative care and services.</li>
 	<li>Medicare Part D: Covers the cost of prescription drugs, flu shots, and vaccines.</li>
</ul>
You can combine all three parts of Medicare for comprehensive coverage. Additionally, there are two types of Medicare plans:3
<ul>
 	<li>Original Medicare: The original Medicare program includes Medicare Part A and Medicare Part B. With Original Medicare, you pay a coinsurance fee, which is about 20% of the cost of service. You can add a prescription drug plan (Part D).</li>
 	<li>Medicare Advantage: This is a bundled “all in one” plan that includes Part A, Part B, and usually Part D. This plan also provides extra services that Original Medicare doesn’t cover.</li>
</ul>
Many substance abuse facilities accept Medicare for <a href="https://veteranaddiction.org/rehab-treatment/">drug rehab treatment</a>. People may use a variety of different insurances to cover drug rehab, including Medicare. In 2017, of the more than 13,500 substance abuse treatment facilities, over 35% (about 4,767) accepted Medicare as a form of payment.4
<h2 id="medicare-eligibility">Medicare Eligibility Requirements</h2>
If you meet the eligibility requirements, you can enroll in and obtain Medicare. These requirements are as follows:3
<ul>
 	<li>You are age 65 or older.</li>
 	<li>You are younger than 65 but have certain disabilities.</li>
 	<li>You have been diagnosed with end-stage renal disease (permanent kidney failure requiring dialysis or a transplant, sometimes called ESRD).</li>
</ul>
Meeting these eligibility requirements is an important first step in accessing Medicare rehab coverage for substance abuse.
<h2 id="veterans-apply-medicare">Can Veterans Apply for Medicare?</h2>
If you are a veteran and meet the eligibility requirements listed above, then you may be able to enroll in Medicare. If you decide you want Medicare insurance, it’s important to enroll at the right time. If you don’t, you will incur a late-enrollment penalty.5 The enrollment period is seven months long, so there is adequate time to get in on the program. The enrollment period usually begins three months before you turn 65, includes the month of your birthday, and extends three months after your birthday has passed.5

<h2 id="medicare-va-benefits">Do I Need Medicare If I Have VA Benefits?</h2>
Veterans are covered by their VA benefits, but those benefits are not the same for each recipient. Also, these benefits may not cover every aspect of addiction treatment that you need.1 While you do have a choice regarding Medicare enrollment, there is no reason not to enroll. Medicare simply adds to your VA benefits; it doesn’t take anything away from them.1 So, for example, if your VA benefits are not accepted at a certain facility or don’t cover certain rehab treatments, you can use the Medicare rehab coverage as a supplement. In some instances, Medicare may be the primary source of insurance for your rehab treatment.

The other benefit of enrolling in Medicare is that you might not always have VA coverage.1 Then, if you haven’t enrolled in Medicare, you will have to pay penalties and possibly wait a while to get into the program.1 Instead, veterans can have both insurances at once, so they will be ensured of adequate coverage.
<h2 id="medicare-cover-rehab">Does Medicare Cover Rehab?</h2>
Medicare can be used to cover the cost of addiction treatment for veterans. It will allow recipients to participate in Medicare substance abuse programs. Whether you need <a href="https://veteranaddiction.org/rehab-guide/inpatient-rehab/">inpatient hospital rehab</a> or a partial hospitalization program, you can access your Medicare rehab coverage to help with the costs. Make sure to let the rehab coordinator know that you have both insurances—VA benefits and Medicare coverage. Even though the VA healthcare benefits and Medicare insurance are federally funded they are operated by different agencies.1 Both insurances can be used simultaneously for the best substance abuse coverage.1

Medicare covers an array of addiction rehab services for veterans. These services fall under the behavioral and mental health services for Medicare recipients. Veterans seeking assistance for substance use disorder may be able to obtain Medicare drug and alcohol rehab coverage for the following services:6

 	<li><a href="https://veteranaddiction.org/rehab-guide/drug-detox/">Detox</a>: This program may include types of medication-assisted treatment (such as methadone and buprenorphine).</li>
 	<li>Inpatient hospital treatment: During an inpatient program, you will have continual supervision and access to treatment.</li>
 	<li><a href="https://veteranaddiction.org/rehab-guide/outpatient-rehab/">Outpatient treatment programs</a>: You can attend treatment programs that range in intensity and duration.</li>

<h3 id="medicare-cover-medications">Does Medicare Cover Medications?</h3>
Medication-assisted treatment (MAT) is a type of treatment program sometimes offered at addiction treatment facilities. Medicare covers <a href="https://veteranaddiction.org/medication-assisted-treatment/">MAT programs</a> as a comprehensive benefit under Medicare Parts A, B, and C, and some falls under Part D.7

A MAT program uses medication combined with behavioral therapy to assist people with substance use disorder, especially opioid use disorder. The following drugs have been approved by the FDA for this purpose:7

 	<li>Buprenorphine, a component of Suboxone, is used to treat opioid addiction.</li>
 	<li>Methadone, used for heroin or other opiates.</li>
 	<li>Naltrexone, used for opioid or alcohol use disorder.</li>

<h2 id="medicaid-and-medicare">Can I have Medicaid and Medicare?</h2>
When someone has both Medicare and <a href="https://veteranaddiction.org/insurance-benefits/medicaid/">Medicaid</a>, they are considered to have “dual eligibility.” 8 This means they are eligible to receive coverage from both of these government-funded institutions. It’s fairly uncommon to have both at the same time; the eligibility requirements for Medicaid and Medicare can be difficult to meet. Further, Medicaid eligibility requirements vary by state, whereas Medicare's eligibility requirements are set by the federal government. About 20% of people receiving Medicare also receive Medicaid, which is 12.1 million people.8 These requirements are discussed further in the section below.

<h3 id="medicare-difference">Medicaid vs Medicare: What's the Difference?</h3>
Medicare and Medicaid are both federally funded programs.9 Medicaid is a joint federal and state program with funds and eligibility being distributed at the state level. Every state has its own eligibility requirements for receiving Medicaid, but it’s always based on income.9 People who are in the lower-income bracket are usually eligible. You can check with your state to find out what the income limitations are for your family size.9 Medicaid also has limits on how much resources you can have.9 However, veterans who are a little bit above the income parameters can “spend down” their income and become eligible. This process is accomplished by subtracting medical expenses from your income.9

</ul>
Often, people with mental health conditions will turn to drinking as a way to cope with their problems.1 This type of self-medicating only leads to greater distress because alcohol doesn’t treat the underlying mental health disorder. Consequently, mental health and alcohol use disorders should be treated in tandem to ensure you get to the root of the issue and avoid relapsing.
<h2 id="alcoholism-veterans">Alcoholism in Veterans</h2>
Veteran populations are at greater risk for all types of substance abuse, including alcohol addiction. This is largely due to their position as military personnel and the unique challenges and stresses posed by combat and reintegration into civilian life. Veterans are more susceptible to addiction issues due to the following reasons:3

 	<li>Alcohol is a common problematic substance for veterans, with approximately 10.5% of male veterans and 4.8% of female veterans struggling with alcohol use disorder.3 </li>
 	<li>Alcohol was also linked to 20% of risky behaviors that led to deaths amongst veterans. This is highlighted by the fact that more than one in three military personnel are defined as hazardous drinkers, where are 5.4% qualify as heavy drinkers.5</li>

<h3 id="alcohol-abuse-mental-health">Alcohol Abuse &amp; Co-Occurring Mental Health Disorders</h3>
Co-occurring mental health disorders often increase the risks of veterans developing an alcohol use disorder. While common mental health disorders like depression or anxiety can cause people to seek alcohol as a way to cope, post-traumatic stress disorder (PTSD) is a common condition affecting veterans that can increase the risk of alcoholism. Statistics show that one in three veterans who sought treatment for alcoholism also struggled with PTSD.4

PTSD is a mental health condition that occurs in people after they witness or experience a traumatic event.6 For military personnel, these events could involve anything from seeing people killed to feeling the earth shake when a bomb explodes. PTSD can manifest in veterans during service and during civilian life. Common <a href="https://veteranaddiction.org/mental-health/ptsd/">symptoms of PTSD</a> include:6

 	<li>Recurring nightmares about incidents that occurred.</li>
 	<li>Difficulty sleeping.</li>
 	<li>Anxiety.</li>
 	<li>Feeling on edge.</li>
</ul>
<a href="https://veteranaddiction.org/rehab-guide/homeless-veterans/">Homeless veterans</a> have an even greater risk of co-occurring disorders, such as a mental illness and an alcohol use disorder.7 Finally, depression is also linked to substance use in veterans. All of the traumatic events in which veterans are exposed can lead to depression.3
<h3 id="impacts-alcoholism">Impacts of Alcoholism on Veterans</h3>
When left untreated, alcoholism has a detrimental effect on anyone, but it’s especially harmful to veterans. With all the difficulties they have gone through, especially if they’ve been in combat, alcoholism only worsens their condition. Research indicates there is a link between veterans who have experienced trauma during the military with alcohol use.8

Alcoholism among veterans may lead to homelessness, too.7 However, the research is still unclear; some data suggests that homelessness may lead veterans to developing an alcohol use disorder. Either way, there is a link between homeless veterans and various substance use and alcohol use disorders.7

Alcoholism in veterans is also linked to an increased risk of suicide. About 30% of suicides and 45% of attempts involved either alcohol or drug use.5
<h2 id="signs-alcohol-abuse">Signs of Alcohol Abuse &amp; Addiction</h2>
If you suspect you or someone you love may have an alcohol use disorder, it’s helpful to know the signs and symptoms. To have an actual diagnosis, you must meet the criteria that are outlined in the Diagnostic and Statistic Manual of Mental Disorders (DSM).1 If you have any 2 of the following signs during a 12-month period, it could indicate alcohol use disorder:1
<ul>
 	<li>Ended up drinking more or longer than you planned.</li>
 	<li>Have tried to cut down or stop drinking but couldn’t.</li>
 	<li>Spend a lot of time drinking or getting over the aftereffects of drinking (hangover).</li>
 	<li>Have cravings to drink.</li>
 	<li>Discovered that drinking—or being sick from drinking—is interfering with daily responsibilities, such as your job, family, bills, or home.</li>
 	<li>Didn’t stop drinking even though it causes more trouble with family or friends.</li>
 	<li>Stopped engaging in pleasurable activities (or cut back on them) in order to drink.</li>
 	<li>Keep getting into risky situations while or after drinking, such as drunk driving.</li>
 	<li>Kept drinking even though you feel depressed or anxious doing so.</li>
 	<li>Need to drink much more to get the same effect as you once had in the beginning.</li>
 	<li>When the effects of alcohol wear off, you notice withdrawal symptoms, such as insomnia, shakiness, anxiety, moodiness, depression, nausea, restlessness, or sweating.</li>

Alcoholism in veterans can be linked to service-related mental health conditions. For example, if a veteran developed PTSD after a traumatic event during services, and consequently develops an alcohol use disorder as a result of PTSD, they may be eligible for disability benefits.

It's worth noting that there are some scenarios in which substance abuse may negatively impact your veterans benefits. Most of these scenarios are linked to the concept of willful misconduct. Essentially, the VA defines willful misconduct as when a veteran engages in risky behavior without care about potential negative consequences.14 For example, if a veteran knowing get drunks and injures themselves, the VA would consider this willful misconduct, and likely deny disability benefits for the injuries.14 
<h3 id="va-disability-alcohol">The VA Disability Rating for Alcohol Use Disorders</h3>
The VA uses a disability rating when giving benefits to veterans. The VA will rate the severity of your service-induced disability.10 This rating determines how much compensation you will receive.10 The higher the rating, the more you receive in compensation. For example, in 2020, if your disability rating was 30% and you have a dependent spouse, you received $441.35 a month. If it was 60%, you would receive $1,146.39.11 This monthly payment can assist you with continuing your addiction treatment program.

A veterans treatment court is a rigorous program that calls for personal accountability while seeking to break the cycle of drug use and criminal behavior.1 By participating in a veterans treatment court, veterans have the opportunity to work through substance abuse and maintain recovery.

Veterans are at a higher risk for substance use disorder compared with civilians, with one in ten veterans struggling with substance abuse.2 The statistics are even more worrisome for veterans who served in Operation Iraqi Freedom or Operation Enduring Freedom. One of every six of these veterans experience a substance use disorder.3

Substance use disorder is also associated with a higher prevalence of <a href="https://veteranaddiction.org/veterans-mental-health-issues/">mental illness</a>.4 People with one condition often have the other condition as well.4 In other words, these disorders are often co-occurring. When a veteran returns from service and experiences one or both of these types of conditions, without receiving appropriate treatment services, they are at risk for entering the criminal justice pipeline.3 This is why the veteran treatment courts were first developed.1 Through this court program, veterans receive needed help, and the public has fewer safety issues due to criminal behavior.1
<h2 id="treatment-court-work">How Does Veteran Treatment Court Work?</h2>
A treatment court program works with a specific veterans-only docket.1 This is essential in the success of the program because it takes into consideration veterans' special circumstances. Instead of issuing sentences that punish veterans for criminal activity, veteran treatment courts target the veteran’s medical disorders and provide programs and support that get to the root of the problematic behavior.1 Treatment courts also put veterans in an environment with their peers.1 When veterans have support coupled with substance abuse treatment, they can move forward in recovery.

In a veterans treatment court program, veterans will be required to attend regular treatment sessions, appear before the court, and undergo random drug testing.1 This allows veterans to participate in a highly structures and disciplined program, not dissimilar to the way the military functions.
<h3 id="crimes-cover">What Crimes Do They Cover?</h3>
Veteran treatment courts address petty misdemeanor crimes that don’t involve sexual or violent components. For violent crimes, veterans may need to serve time in jail.

In a veterans court program, a judge will regularly check on the veteran's progress. If they fail a drug test or don’t comply with an aspect of the treatment regimen, they may have to pay a fine or serve jail time.
<h3 id="effectiveness-treatment-court">Effectiveness of Veterans Treatment Court</h3>
A veterans treatment court effectively assists veterans who would otherwise fall through the cracks. Statistics on veterans treatment courts include:5
<ul>
 	<li>Treatment court participants have consistently lower recidivism rates than regular court participants.</li>
 	<li>A study of over 22,000 veterans found that participants were better equipped to find housing and employment compared to other veterans in the criminal justice system.</li>
 	<li>One study showed that veterans treatment court participants had increased improvements in mental health, overall functioning, and social connectedness.</li>
 	<li>Research reflects that a veterans treatment court program resulted in 10% more participants in stable housing.</li>
 	<li>Veterans treatment courts may result in 12% more veterans receiving VA benefits.</li>
</ul>
<h2 id="pros-cons-treatment-court">What Are the Pros &amp; Cons of Veterans Treatment Courts?</h2>
Veterans may want to weigh the pros and cons of a veterans treatment court if they have struggled with substance use disorder, mental health disorder, or both. Understanding the benefits or downsides can help you decide whether you want to enter into this type of program. The pros are obvious. You avoid jail time and also get treatment for underlying problems that you are facing. One potential hurdle for vets is that they will have to be accountable to others. They will need to check in regularly and undergo drug testing. Further, while over 40 states have veterans treatment courts, some do not, possibly restricting access for veterans.6

<h2 id="eligibility-treatment-court">Eligibility for Veterans Treatment Court</h2>
Court eligibility criteria may differ from state to state. However, all veterans' treatment courts follow a similar framework. If a veteran is facing a criminal charge, they can check to see if they meet court admission requirements.2 If they do, they will be provided an opportunity to complete a customized treatment program and avoid incarceration.2 Alternatively, they might receive a reduced sentence.2
<h3 id="va-benefits-treatment">Do I Need VA Benefits for Treatment?</h3>

Veterans Treatment Court: Guide to Court Diversion Programs

Homelessness is a prevalent and traumatic social phenomenon in the United States, with estimates showing that homelessness rates increased by 2.2 percent from 2019 to 2020. Homelessness can happen to anybody, and veterans may find themselves in vulnerable situations that could lead to homelessness.

According to research, the risk for veterans to become homeless is higher than that of the general population.1 Central factors that contribute to veteran homelessness in the U.S. include substance use disorders and <a href="https://veteranaddiction.org/veterans-mental-health-issues/">mental health disorders</a> like post-traumatic stress disorder (PTSD), and the co-occurrence of these types of disorders.1 Other issues play a smaller role, including income problems, social isolation, having been incarcerated, and childhood trauma.1 Although this problem may seem insurmountable, various programs exist to help veterans beat homelessness.

<h2 id="homeless-veteran">What is a Homeless Veteran?</h2>
The United States Department of Housing and Urban Development (HUD) clarifies that a person is experiencing homelessness if they meet any of these criteria:2
<ul>
 	<li>A person who does not have a “fixed, regular, and adequate nighttime residence.”</li>
 	<li>Someone who stays overnight at a public or private place not designed for or ordinarily used for sleeping (i.e., car, abandoned building, park, bus or train station, camping ground, or airport).</li>
 	<li>A person who is living in a temporary shelter. These could include homeless shelters, motels paid for by the government or by charities, and transitional housing.</li>
 	<li>Someone who is living in a place not meant for human habitation.</li>
 	<li>A person who is getting ready to lose their home and has no other place to go.</li>
</ul>
<h2 id="causes-risks-veteran-homelessness">Causes &amp; Risk Factors for Veteran Homelessness</h2>
Homelessness is more prevalent among veterans than it is in the general population.1 A variety of factors contribute to homelessness in any population, and each situation is unique. However, some trends in veteran homelessness cannot be overlooked. Two main factors play a role in veterans becoming homeless— substance use and mental illness.1

Results of 31 studies on the causes of homelessness in veterans point to substance use as the most consequential risk factor.1 Experiencing a mental health disorder was also a strong risk factor in a veteran becoming homeless, and PTSD was a particular focus in the studies.1 However, it was determined that PTSD, while a factor, was not a greater risk than any other mental health disorder.1 Vets who have PTSD may be more likely to use substances as a way to cope with PTSD symptoms. We know from other research that there is a strong link between substance use disorder and mental illness, which could account for why veterans facing homelessness frequently experienced both of these risk factors.3 The studies also indicated other factors that could contribute to homelessness in veterans.

Veterans facing homelessness, or the risk of homelessness, were likely to struggle with these homelessness risk factors (listed in order of relevance):1
<ul>
 	<li>Substance use.</li>
 	<li>Mental illness.</li>
 	<li>Lack of income or low income.</li>
 	<li>Lack of social support.</li>
 	<li>Adverse childhood experiences.</li>
</ul>
<h2 id="statistics-veteran-homelessness">Statistics &amp; Facts About Veteran Homelessness</h2>
As mentioned above, research indicates that veterans experience homelessness and are at a higher risk for homelessness compared to the greater population. The following statistics and facts about veteran homelessness illustrate the extent of the problem:4, 5
<ul>
 	<li>In 2020, the number of homeless veterans was 37,252, an increase of less than 1 percent from 37,085 in 2019.</li>
 	<li>59% of the veterans in 2020 were sheltered.</li>
 	<li>98% of homeless veterans have a chronic pattern of homelessness.</li>
 	<li>Men made up 91 % of the veteran homeless population.</li>
 	<li>African American veterans made up one-third of homeless veterans.</li>
 	<li>California has just over one-third of all homeless veterans. Four states have seven out of ten homeless veterans. These states are California, New Mexico, Oregon, and Georgia.</li>
 	<li>Veterans who were in the conflicts Operation Enduring Freedom or Operation Iraqi Freedom have a 27% higher rate of substance use disorder than veterans involved in other conflicts.</li>
</ul>
<h2 id="substance-abuse-veteran-homelessness">How Does Substance Abuse Play into Veteran Homelessness?</h2>
How does substance misuse contribute to or lead to homelessness among veterans? First, <a href="https://veteranaddiction.org/veterans-and-substance-use-disorders/">substance use disorder</a> (SUD) can lead to continued compulsive behavior even if it harms the person's life.6 For example, it can create difficulties keeping up with work responsibilities, money management, and interpersonal relationships.6 Therefore, SUD can easily lead to a veteran losing their home and becoming homeless.

Second, SUD is strongly connected to experiencing mental health disorders. Experiencing both conditions increases the risk of experiencing homelessness. Seeking treatment for both conditions through a co-occurring disorder treatment program will help veterans find the path to recovery. Many facilities, whether part the Department of Veterans Affairs (VA) health network or a private facility, offer specialized treatment tracks for veterans struggling with substance abuse and co-occurring mental health disorders.
<h2 id="laws-programs-aid">Laws, Programs, &amp; Aid</h2>
Various programs and grants are available to offer homeless veteran assistance and support. Some examples include:
<ul>
 	<li>The Homeless Veterans' Reintegration Program: this is a program that helps reintegrate veterans into the workplace.7</li>
 	<li>HUD–VA Supportive Housing: this collaborative effort between HUD and the VA helps veterans with housing.8</li>
 	<li>Department of Veterans Affairs Vocational Rehabilitation and Employment Services: this program helps disabled veterans with employment training.9</li>
 	<li>Supportive Services for Veteran Families: this program provides funding to agencies and community groups that assist veterans who may be in danger of losing their homes. It provides supportive services during this time, and if the veteran does lose housing, they work to find them a new home.8</li>
</ul>

<h2 id="help-homeless-veterans">How You Can Help Homeless Veterans</h2>
You can play a role in addressing veteran homelessness. If you have extra housing that you rent out to a veteran, you can work with the HUD-VA Supportive Housing program. You can contact a veteran’s homeless shelter or outreach program to find out what type of supplies you can donate. Some people may want to participate in serving homeless veterans in a greater capacity.

Veteran Homelessness: Risks, Statistics & Assistance Programs

Confidentiality is an important aspect of medical care for all patients. It is why the U.S. Department of Health and Human Services (HHS) established the Health Insurance Portability and Accountability Act of 1996—otherwise known as HIPAA.1 A sweeping legislation, HIPAA updated medical privacy laws, allowing for patients to attend treatment with peace of mind in the 21st century.

Veterans especially may be concerned with privacy. When they come back from service, they sometimes face a multitude of medical and mental health challenges, including substance use disorder. Due to the nature of VA benefits, many veterans fear that rehab will go on their record and jeopardize VA coverage. However, most forms of substance abuse treatment are covered by the VA and kept confidential under the provision of HIPAA.

<h2 id="hipaa-medical-records">HIPAA, Medical Records &amp; Laws</h2>
HIPAA is a federal law that protects the privacy of people’s health information by ensuring that sensitive information is not disclosed without the person’s permission.1 The HIPAA Privacy Rule addresses the disclosure of a person’s health information by various entities, referred to as “covered entities.”1

Under the Privacy Rule there are standards for your rights and how you can control the way your health information is used.1 Some covered entities may need access to certain medical information. For example, if you are receiving emergency medical treatment, the acting physician needs to know what prescriptions you are taking to ensure you don’t receive treatment that would cause a negative interaction. The physician in this example would likely not be bound by the HIPAA Privacy Rule. However, the Privacy Rule strives to maintain a balance between sharing vital information and your right to privacy, and will hold in most situations.

In 2002, the Department of Veterans Affairs (VA) founded the VA Privacy Services (PS) to maintain and protect veterans’ right to confidentiality.2 As a part of this goal, the VA focuses on two acts: 2

 	<li>Privacy Act of 1974.</li>
 	<li>HIPAA.</li>
</ul>
The VA Privacy Services’ central department oversees the information flowing to and from these entities, making sure that veterans have access to and control over their medical information.2 Veterans are allowed to:2
<ul>
 	<li>Access their own health information.</li>
 	<li>Receive copies of information about their medical health.</li>
 	<li>Ask for corrections to any incorrect information.</li>
</ul>
A veteran has the right to request that their information not be disclosed to others.2 The Veteran Health Administration must request permission from veterans in writing to disclose health information, except in limited situations.2

HIPAA ensures the protected health information (PHI) of people in the Armed Forces personnel is disclosed only under special circumstances.3 This provision is referred to as the Military Command Exception.3

The Confidentiality of Alcohol and Drug Abuse Patient Records regulations were issued in 1975. These provisions ensure confidentiality to anyone seeking treatment for substance use.4 The only time that rehab and other treatment can be disclosed is in cases of medical emergency, suspected child abuse, criminal investigations, and program audits.4 When it comes to HIPAA and substance abuse, you can have peace of mind knowing your privacy is protected.
<h2 id="doctor-patient-confidentiality">Doctor-Patient Confidentiality &amp; Drug Use</h2>
Whether a veteran meets with a primary care physician or a substance abuse rehab provider, they want to know that their personal information is protected. According to federal law, patients have special rights when it comes to their substance use history.5 Under Title 42 of the Code of Federal Regulations (CFR) Part 2, patients can expect privacy concerning any substance use disorder.5 Doctors and providers can’t give out information about a patient’s drug use without that person’s written consent.5

Past or current substance use can’t be used against you in determining employment, divorce cases, or custody battles.5 You can be assured of doctor-patient confidentiality for illegal drug use, too.
<h2 id="drug-use-background-check">Will Prior Rehab or Drug Use Show Up On a Background Check?</h2>
Some people may be worried about whether drug rehab shows up on their medical records, and how that might affect their future. This could cause them to hold back on seeking treatment, which is detrimental to their well-being. This is a real concern when a veteran is looking for a new career or job. Sometimes prospective employers will run a background check on people they might hire. However, employers must abide by all the laws and rules set forth by HIPAA and the Privacy Act if they do run a check.5 They can’t get around the law and try to extract information about your past drug or alcohol use.
<h2 id="drug-use-va-benefits">Can Drug Use or Rehab Impact VA &amp; Veteran Benefits?</h2>
A service-related injury or illness can be compensated with VA benefits. Even if a pre-existing condition was made worse through service, you might be able to collect disability through the VA. There are other conditions that may apply, so it’s best to check directly with the Department of Veterans Affairs for clarification.6

You won’t be disqualified for benefits except in cases of “willful misconduct.”8 Willful misconduct applies when a veteran purposely engages in conduct that is specifically prohibited without regard for the consequences and includes using alcohol or drugs for enjoyment.9

However, the VA recognizes substance use disorders as a disability.7 The VA considers substance use an issue that warrants treatment, and can make exceptions for drug or alcohol use related to pre-existing mental health or physical conditions.7 It's important to reach out to your VA representative to determine the extent of your benefits.

<h2 id="when-info-disclosed">Under What Circumstances Could Information be Disclosed?</h2>
Health information is normally protected, and veterans can be assured that even information about drug or alcohol rehab will remain confidential. However, there are always exceptions to every rule. If you need emergency medical care, doctors may be required to provide limited information about your medical history.1 Outside of an emergency, you can always give written consent for your medical information to be given to select individuals.5

There are some situations in which a veteran might decide to disclose personal information. They may want to have their health history shared with a close relative or spouse in case of an emergency. Some veterans may wish to share medical information between different medical facilities to make care smoother.
<h3 id="penalties-disclosed-info">Penalties for Disclosing Information</h3>
It’s a serious infraction when a medical provider discloses your information without permission. If any covered entities do so knowingly, they can face a fine of up to $50,000, as well as imprisonment of up to 1 year.9
<h2 id="finding-treatment">Finding Treatment</h2>
It's important to remember that HIPAA and its provisions provide a great deal of confidentiality for veterans seeking substance abuse treatment. While there are a few exceptions, veterans should still feel confident in the confidentiality HIPAA provides and seek treatment for substance abuse. Contacting the VA is often a great starting point for veterans to begin finding treatment. If the VA can't meet a veteran's treatment needs, a confidential facility in the VA's Community Care Network (VACCN) may be able to provide treatment.
